On March 3, 1972, the claimant, Mark E. Emigholz, filed an application for adjustment of claim with the Industrial Commission to recover workmens compensation benefits from the respondent, the city of Rockford, for injuries sustained in an accident on December 22, 1971. The claimant alleged that on that date he was serving the respondent as a police officer. The arbitrator awarded the claimant $4,758, and the Commission affirmed the decision of the arbitrator. The respondent took an appeal by certiorari to the circuit court of Winnebago County, which ultimately confirmed the decision of the Commission, and the respondent filed a notice of appeal to this court under Rule 302(a) (58 Ill.2d R. 302(a)). The Page 600 circuit court stayed its final judgment pending disposition of the appeal.
